Terms of Service & End User License Agreement

These Terms of Service and End User License Agreement ("Terms") are a legal agreement between you and HelioLogix LLC ("HelioLogix," "we," "us") governing your use of the HelioMaps mobile app and related services (the "App"). By downloading, accessing, or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. By using it you represent that you are 18 or older and able to enter into a binding contract.

2. License

Subject to these Terms, HelioLogix grants you a personal, limited, non‑exclusive, non‑transferable, revocable license to use the App on devices you own or control, for your own non‑commercial hunting and land‑management purposes. You may not copy, modify, reverse‑engineer, resell, sublicense, scrape, or redistribute the App or its data except as allowed by law.

3. Not for navigation, surveying, or legal boundaries

4. Assumption of risk (hunting & firearms)

Hunting and the use of firearms, bows, tree stands, vehicles, and the outdoors are inherently dangerous activities. You are solely responsible for your own safety and conduct and for complying with all federal, state, and local laws, licensing, and hunting regulations. You knowingly and voluntarily assume all risk arising from your use of the App and your hunting, shooting, navigation, and land‑access decisions.

5. Predictions and weather are estimates

Rut timing, game activity and movement predictions, wind, and weather in the App are estimates and forecasts from models and third‑party data. They are not guarantees. Do not rely on them for safety‑critical decisions.

6. Your account and content

You are responsible for your account and for the pins, notes, photos, boundaries, tracks, and other content you create ("User Content"). You retain ownership of your User Content and grant HelioLogix a license to host, process, back up, and, where you choose to share a map, display it to the people you share it with, solely to operate the App. You are responsible for having the rights to any content you upload and for anything you share. Do not upload unlawful content or content that infringes others' rights or privacy, and do not use the App to harass, stalk, or locate any person without consent. We may remove content or suspend accounts that violate these Terms.

7. Sharing & live location

The App lets you share maps and, if you turn it on, your live location with people you choose. You are responsible for whom you share with. Live‑location sharing is opt‑in and can be turned off at any time; do not use it to track anyone without their knowledge and consent.

8. Subscriptions (HelioMaps Pro and Scout)

Certain features require a paid subscription. HelioMaps Pro is billed annually; HelioMaps Scout (when available) is billed annually or monthly. Both are sold through the Apple App Store or Google Play, and the price and billing period are shown in the App before purchase. Subscriptions renew automatically at the then‑current price unless you cancel at least 24 hours before the end of the current period. Payment is charged to your store account, and you manage or cancel the subscription in your Apple or Google account settings, deleting the App does not cancel it. Except where required by law or the applicable store's policies, payments are non‑refundable.

9. Third‑party services and data

The App uses third‑party maps, imagery, geocoding, routing, weather, and advertising services (including USGS, OpenStreetMap contributors, MapTiler, Stadia Maps, Google (Map Tiles API), Mapbox/Maxar, the National Weather Service, Google AdMob, RevenueCat, and Supabase). Your use may also be subject to those providers' terms, and their data is provided "as is." See the in‑app Legal & credits screen and our Privacy Policy.

10. Disclaimer of warranties

THE APP AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non‑infringement. HelioLogix does not warrant that the App will be uninterrupted, error‑free, accurate, or available offline, or that data (including boundaries, parcels, routes, rut, or weather) is correct.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HELIOLOGIX AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, PROPERTY, INJURY, OR DEATH, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP OR RELIANCE ON ITS DATA, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (b) US$50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold HelioLogix harmless from claims and expenses arising out of your use of the App, your User Content, your sharing, or your violation of these Terms or of any law or third‑party right.

13. Termination

You may stop using the App and delete your account at any time (Account ▸ Delete account). We may suspend or terminate access for any violation of these Terms. Sections 3–6 and 10–15 survive termination.

14. Governing law & disputes

These Terms are governed by the laws of the State of [STATE], without regard to conflict‑of‑laws rules. [Any dispute will be resolved by binding individual arbitration and you and HelioLogix waive class actions and jury trials, except where prohibited by law. CONFIRM/ADJUST WITH COUNSEL.]

15. Changes

We may update these Terms; we will post the new version here and update the date above. Continued use after changes means you accept them.
