HelioMaps Terms of Service and End User License Agreement
Effective date: August 27, 2026
These Terms of Service and End User License Agreement ("Terms") are a legally binding agreement between you and HelioLogix LLC ("HelioLogix," "we," "our," or "us"). These Terms govern your access to and use of the HelioMaps mobile application, websites, software, map data, subscriptions, connected‑device functions, and related products and services collectively referred to as the "Service."
By downloading the HelioMaps application, creating an account, purchasing a subscription, clicking an acceptance button, or accessing or using any portion of the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.
PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT SAFETY DISCLAIMERS, A LIMITATION OF LIABILITY, AN ASSUMPTION‑OF‑RISK PROVISION, AND, SUBJECT TO APPLICABLE LAW, AN AGREEMENT TO RESOLVE DISPUTES THROUGH INDIVIDUAL ARBITRATION RATHER THAN A JURY TRIAL OR CLASS ACTION.
1. Eligibility
You must be at least eighteen years old and legally capable of entering into a binding agreement to use the Service.
By using the Service, you represent that you meet these requirements and are not prohibited from using the Service under applicable law.
You may not permit a minor to use the Service for hunting, firearm, navigation, or location‑sharing purposes without the direct supervision of a parent or legal guardian. This provision does not make the Service intended or directed toward children.
2. Privacy
Our Privacy Policy describes the information we collect, how we use it, the service providers with whom it may be shared, and the choices available to you.
Certain features require access to device location, photos, storage, internet connectivity, Bluetooth, notifications, or other device capabilities. You may control many of these permissions through your device settings, but disabling them may prevent features from functioning.
3. License to Use the Service
Subject to your continued compliance with these Terms, HelioLogix grants you a limited, personal, revocable, non‑exclusive, non‑transferable, and non‑sublicensable license to install and use the HelioMaps application on devices that you own or control.
You may use the Service for personal hunting, outdoor recreation, and the internal management of land that you own, lease, manage, or are otherwise authorized to access.
Unless HelioLogix has authorized it in a separate written agreement, you may not use the Service to operate a commercial mapping service, resell access, sell or redistribute data, provide bulk parcel information to others, build a competing product, or commercially exploit the Service or its data.
The Service is licensed, not sold. HelioLogix and its licensors reserve all rights not expressly granted in these Terms.
4. Prohibited Activities
You may not:
- Copy, reproduce, modify, translate, distribute, sell, lease, sublicense, or create derivative works from the Service except as expressly permitted by law.
- Reverse engineer, decompile, disassemble, decode, or attempt to discover source code, data structures, algorithms, security controls, or nonpublic application interfaces.
- Scrape, crawl, harvest, download in bulk, systematically query, or extract parcel, ownership, imagery, terrain, user, or other data.
- Use bots, scripts, automated tools, emulators, or excessive queries that interfere with the Service or impose an unreasonable load.
- Circumvent subscription limits, access controls, download limits, geographic restrictions, or technical protections.
- Share, sell, transfer, or provide unauthorized access to your account.
- Use the Service to violate hunting, firearm, trespass, privacy, stalking, harassment, wildlife, land‑use, or other laws.
- Track, monitor, photograph, or share another person's location without appropriate knowledge, permission, and legal authority.
- Upload unlawful, deceptive, defamatory, threatening, infringing, obscene, malicious, or privacy‑invasive content.
- Use the Service to identify, target, threaten, harass, or harm a landowner, hunter, employee, public official, or other person.
- Upload malware or interfere with the operation, security, integrity, or availability of the Service.
- Misrepresent your identity, affiliation, ownership, permission, or authority to access land.
- Remove copyright, trademark, attribution, source, or proprietary notices.
- Use the Service for law‑enforcement surveillance, emergency dispatch, search and rescue, or other safety‑critical operations without a separate written agreement from HelioLogix.
5. Accounts and Account Security
Some features may be used without an account. Other features, including cloud backup, syncing, shared maps, live‑location sharing, subscriptions, and connected‑device functions, may require an account.
You agree to provide accurate information and keep it current. You are responsible for:
- Maintaining the confidentiality and security of your login credentials.
- All activity occurring through your account.
- Restricting access to devices on which your account is signed in.
- Promptly notifying us of suspected unauthorized use or security incidents.
We may suspend or restrict an account when we reasonably believe it has been compromised, is being shared improperly, is violating these Terms, or presents a risk to the Service or others.
6. Map, Parcel, Ownership, and Boundary Data
HELIOMAPS IS NOT A SURVEY, TITLE REPORT, DEED, LEGAL DESCRIPTION, APPRAISAL, OWNERSHIP GUARANTEE, OR AUTHORITATIVE GOVERNMENT RECORD.
Parcel boundaries, owner names, acreage, addresses, public‑land designations, roads, trails, easements, access points, fences, water features, and other information may be compiled from public records, government agencies, licensors, users, and other third parties.
This information may be inaccurate, incomplete, generalized, delayed, incorrectly matched, or out of date. Ownership, access rights, road status, public‑land status, easements, hunting leases, regulations, and physical conditions can change without notice.
Map lines may differ substantially from surveyed boundaries or physical markers. GPS accuracy does not make an underlying boundary legally accurate.
You must independently confirm:
- Property boundaries.
- Current ownership.
- Permission to enter or hunt.
- Easements and access rights.
- Public and private land status.
- Road and trail status.
- Hunting‑unit boundaries.
- Location‑specific firearm and archery restrictions.
- Any other information on which your access or activities depend.
Definitive property information should be obtained from deeds, plats, title records, governmental authorities, landowners, and appropriately licensed surveyors or legal professionals.
Displaying a property, route, owner, road, or access point does not represent that the location is public, open, safe, lawful, accessible, or available for hunting.
7. Measurements and User‑Drawn Features
Distances, acreage calculations, elevations, coordinates, headings, bearings, routes, ranch boundaries, trails, roads, fences, tracks, and other measurements are estimates.
Their accuracy may be affected by map projection, imagery alignment, screen resolution, GPS accuracy, device sensors, user placement, source data, terrain, vegetation, atmosphere, and other conditions.
User‑drawn ranch boundaries, trails, roads, fences, and routes are not independently verified by HelioLogix. Do not use them as legal property descriptions, surveys, construction measurements, emergency coordinates, or evidence of permission or ownership.
8. Navigation, Routing, GPS, and Offline Use
The Service is intended as a general reference and planning aid. It is not designed or warranted for safety‑critical or precision navigation.
Suggested routes may:
- Cross private property.
- Use closed, abandoned, seasonal, unsafe, or nonexistent roads or trails.
- Cross fences, water, cliffs, restricted areas, active hunting areas, or other hazards.
- Fail to account for weather, fire, flooding, construction, gates, landowner restrictions, vehicle limitations, or changing terrain.
You must visually inspect conditions and independently determine whether a route is safe and lawful.
GPS and compass information may be inaccurate or unavailable because of terrain, tree cover, buildings, weather, radio interference, device configuration, battery state, software, or satellite conditions.
Offline maps depend on successful downloads, available device storage, compatible software, uncorrupted files, and the geographic area and detail selected by you. A displayed download does not guarantee that every layer, image, route, record, forecast, or feature will be available offline.
Before entering an area without reliable service, confirm that needed data has downloaded, carry adequate battery capacity, and carry appropriate backup navigation, communication, water, supplies, and safety equipment.
9. Hunting, Firearms, and Outdoor Safety
Hunting, shooting, archery, tree stands, feeders, knives, traps, vehicles, boats, remote locations, wildlife, severe weather, and outdoor travel involve known and unknown risks, including serious bodily injury, death, property damage, criminal charges, and civil liability.
You are solely responsible for:
- Identifying your target and what lies beyond it.
- Confirming that you are in a lawful and safe shooting location.
- Obtaining required licenses, permits, tags, permissions, and training.
- Complying with season dates, bag limits, legal shooting hours, weapon restrictions, hunter‑orange requirements, public‑land rules, burn bans, closures, and all other laws.
- Following firearm, archery, tree‑stand, vehicle, and outdoor‑safety practices.
- Checking official regulations and current conditions.
- Exercising independent judgment and common sense.
No map line, owner record, route, location marker, forecast, prediction, notification, or other information from HelioMaps authorizes you to enter property, hunt, discharge a weapon, operate equipment, or take any other action.
Public land, forest roads, and access
DESIGNATED‑ROUTE AND PUBLIC‑LAND LAYERS ARE A PLANNING REFERENCE, NOT PERMISSION TO DRIVE, ENTER, OR HUNT.
The forest roads and trails layer shows routes a national forest designated for motor vehicle use on its last published Motor Vehicle Use Map (MVUM). The MVUM is reissued each year and routes close between editions. Vehicle class, width, and seasonal limits are set by the managing forest, and a route shown here may be closed, gated, restricted, or removed today.
Driving a route that is not on the current MVUM can result in a citation. You must carry and follow the current MVUM for the forest you are in, and obey posted closures, gates, and signs, whatever this application shows.
Public‑land, BLM, and public‑access‑easement layers show the administering agency or a recorded right of way as published by that agency. They do not establish that land is open to public entry or hunting, that an access route is passable, or that a recorded easement grants you a right to use it. Seasonal closures, permit requirements, safety zones, and local rules apply and are not shown.
Confirm access, legality, and current conditions with the managing agency before you rely on any of it.
10. Weather, Wind, Rut, Game Activity, and Shooting‑Time Information
Weather forecasts, wind information, barometric pressure, precipitation estimates, rut phases, moon information, animal‑activity predictions, historical conditions, legal shooting‑time calculations, and similar information are estimates derived from models, third‑party sources, general observations, geographic assumptions, and automated calculations.
Actual conditions and animal behavior may differ materially.
Legal hunting times and regulations vary by jurisdiction, species, season, date, and location. Information displayed by HelioMaps is not an official hunting regulation and does not replace rules published by the applicable wildlife or governmental authority.
Do not rely on HelioMaps for severe‑weather warnings, fire evacuation, flood safety, avalanche conditions, medical decisions, emergency planning, or any other safety‑critical purpose.
11. Shared Maps and Live‑Location Features
You control whether to share a map or enable live‑location sharing. You are responsible for selecting recipients and understanding what information they may see.
A person who receives access may view, copy, photograph, retain, or further share information. HelioLogix cannot control information after an authorized recipient has accessed it.
Live‑location information may be delayed, inaccurate, interrupted, unavailable, or displayed at the wrong position because of GPS limitations, background‑app restrictions, permissions, connectivity, battery status, device shutdown, account errors, or other conditions.
HELIOMAPS IS NOT AN EMERGENCY COMMUNICATION, PERSONNEL‑ACCOUNTABILITY, SEARCH‑AND‑RESCUE, DISPATCH, OR SOS SERVICE.
The absence, presence, movement, or last reported position of a person on a shared map must not be treated as proof of that person's safety, identity, location, or need for assistance.
Never delay contacting 911 or the appropriate emergency authority because of information displayed or not displayed in HelioMaps.
You may not use location sharing to monitor another person without that person's knowledge, consent, and any legally required authorization.
12. User Content
"User Content" includes pins, notes, labels, ranch boundaries, routes, tracks, photos, trail‑camera images, files, GPX data, messages, and other content you upload, create, import, store, or share through the Service.
You retain ownership of your User Content.
You grant HelioLogix and its service providers a limited, non‑exclusive, worldwide license to host, copy, transmit, process, reformat, back up, synchronize, and display your User Content only as reasonably necessary to:
- Operate and secure the Service.
- Provide features you request.
- Back up and synchronize your content.
- Display content to people with whom you choose to share it.
- Diagnose technical problems.
- Comply with law and enforce these Terms.
This license ends when the content is deleted from our active systems, subject to reasonable backup retention, legal obligations, and content retained by people with whom you shared it.
You represent that you have all rights and permissions needed to upload and use your User Content and that it does not violate another person's copyright, privacy, publicity, contractual, or other rights.
We may remove or restrict content that violates these Terms, creates a security or legal risk, or is the subject of a credible rights complaint.
13. Trail‑Camera Photos and Automated Features
Trail‑camera assignment, recognition, organization, sorting, tagging, historical comparisons, image processing, and other automated or artificial‑intelligence‑assisted features may make mistakes.
Images may be assigned to the wrong camera or location, labeled incorrectly, duplicated, altered in appearance, delayed, or omitted.
Automated results are provided for convenience only and must be reviewed by you before being relied upon.
HelioMaps is not your sole photo‑storage or archival service. You are responsible for retaining independent copies of important photos and files.
Cloud‑storage limits may depend on your subscription. Content that exceeds applicable limits may fail to upload or may require deletion, download, or a subscription change.
14. Connected Devices and Feeder Timers
This section applies when the Service connects to, configures, monitors, schedules, or controls a feeder timer, camera, sensor, motor, or other physical device.
Connected‑device commands may be delayed, duplicated, rejected, interrupted, or fail because of Bluetooth, Wi‑Fi, cellular service, radio interference, battery condition, wiring, mechanical failure, software, configuration, or other factors.
The Service does not guarantee that a feeder will activate, stop, report accurately, remain synchronized, or operate at a requested time.
Before remotely or locally activating equipment, you must ensure that people, animals, clothing, tools, and property are clear of moving mechanisms and electrical hazards. You must follow the device instructions, inspect equipment regularly, and use appropriate guards, fuses, disconnects, and safety procedures.
Do not rely on a notification, battery reading, feed event, motor reading, level estimate, photo, or status indicator as proof that physical equipment is safe or functioning correctly.
You assume responsibility for the installation, maintenance, wiring, configuration, mounting, and use of connected equipment unless a separate written warranty expressly states otherwise.
15. Third‑Party Data and Services
The Service may use or display data, software, maps, imagery, weather, geocoding, advertisements, routing, payment processing, hosting, authentication, or other services supplied by third parties.
Third‑party content and services may be subject to separate terms, licenses, attribution requirements, privacy policies, limits, and availability.
HelioLogix does not control and is not responsible for third‑party services, websites, advertisements, products, transactions, representations, security, outages, or changes.
A link, advertisement, listing, or integration does not constitute an endorsement or warranty by HelioLogix.
Your dealings with advertisers, landowners, outfitters, retailers, service providers, or other third parties are solely between you and that third party.
Google Maps
HelioMaps includes Google Maps features and content. Your use of Google Maps features and content is subject to the then‑current versions of the Google Maps End User Additional Terms of Service and the Google Privacy Policy.
OpenStreetMap
Road and trail data you import into a map, and routing along real roads, are derived from OpenStreetMap. That data is © OpenStreetMap contributors and is made available under the Open Database License.
16. Subscriptions, Billing, and Cancellation
Certain features require a paid subscription, including HelioMaps Pro, HelioMaps Scout, or other plans that may be offered.
Prices, billing periods, storage limits, included features, trial terms, and renewal terms will be shown before purchase.
Subscriptions purchased through the Apple App Store or Google Play are billed and managed by the applicable store. Unless otherwise disclosed, subscriptions automatically renew at the then‑current price unless canceled through the applicable store before the renewal deadline.
Deleting the application or your HelioMaps account does not necessarily cancel an app‑store subscription.
Refunds, cancellations, billing disputes, and payment methods for app‑store purchases are governed by the applicable store's rules, except where applicable law requires otherwise.
We may change subscription prices, plan names, limits, or included features. Price changes will apply as allowed by applicable law and app‑store requirements.
Promotional, beta, complimentary, bundled, or trial access may expire, be modified, or be withdrawn according to the terms presented with the offer.
17. Beta and Prerelease Features
Some portions of the Service may be identified as beta, experimental, preview, prerelease, or coming soon.
Such features may be incomplete, contain defects, lose data, change substantially, or be discontinued. They may not receive the same support or availability as generally released features.
You should not rely on beta features for safety‑critical, business‑critical, legal, navigation, or archival purposes.
Descriptions of planned or "coming soon" features are statements of present intent and are not guarantees that the features will be released or released by a particular date.
18. Service Availability, Updates, and Changes
We may update, modify, restrict, replace, suspend, or discontinue any portion of the Service, including features, data layers, geographic coverage, imagery, providers, storage limits, advertisements, subscriptions, connected‑device support, and free features.
The Service may be unavailable because of maintenance, outages, third‑party failures, security events, legal restrictions, device incompatibility, or circumstances outside our control.
Updates may be required for continued use and may install automatically according to your device or app‑store settings.
We do not guarantee perpetual access to a particular feature, provider, map layer, data source, operating‑system version, or device.
Nothing in this section limits any refund or consumer right that cannot lawfully be limited.
19. Ownership and Intellectual Property
The Service, excluding User Content and separately identified third‑party materials, is owned by HelioLogix or its licensors and is protected by intellectual‑property and other laws.
HelioMaps, HelioLogix, associated logos, product names, visual designs, software, databases, and original content may not be used without authorization.
If you voluntarily provide suggestions, corrections, ideas, or product feedback, you grant HelioLogix a perpetual, worldwide, royalty‑free right to use that feedback without restriction or compensation. This provision does not give HelioLogix ownership of your private maps, photos, tracks, or other User Content.
20. Copyright Complaints
A person who believes content available through the Service infringes a copyright may send a notice containing sufficient information to identify:
- The copyrighted work.
- The allegedly infringing material and its location.
- The complaining party's contact information.
- The complaining party's good‑faith belief that the use is unauthorized.
- A statement that the information is accurate and that the complaining party is authorized to act.
- A physical or electronic signature.

HelioLogix may remove allegedly infringing material and may terminate repeat infringers where appropriate.
21. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT, DATA, PREDICTIONS, ROUTES, RESULTS, FEATURES, AND CONNECTED‑DEVICE FUNCTIONS ARE PROVIDED "AS IS," "AS AVAILABLE," AND WITH ALL FAULTS.
HelioLogix and its suppliers disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, title, quiet enjoyment, non‑infringement, availability, and security.
We do not warrant that:
- The Service will be accurate, complete, current, uninterrupted, secure, or error‑free.
- Defects will be corrected.
- Data will be retained or successfully backed up.
- A route, property line, owner record, forecast, prediction, legal‑time calculation, measurement, or location will be correct.
- Offline or connected‑device functions will operate when needed.
- The Service will satisfy your requirements or produce any particular hunting, scouting, land‑management, or equipment result.
Some jurisdictions do not allow particular warranty exclusions, so some exclusions may not apply to you.
22. Assumption of Risk and Release
You understand that using the Service in connection with hunting, firearms, archery, wildlife, remote travel, vehicles, equipment, private property, severe weather, and outdoor activities involves known and unknown risks.
To the maximum extent permitted by law, you knowingly and voluntarily assume the risks of property damage, data loss, economic loss, civil or criminal liability, bodily injury, and death arising from your outdoor activities, decisions, equipment, and reliance on the Service.
To the maximum extent permitted by law, you release and hold harmless HelioLogix, its affiliates, licensors, service providers, officers, employees, contractors, and agents from claims arising from those assumed risks, except to the extent caused by a party's gross negligence, willful misconduct, or other liability that cannot legally be released.
23. Limitation of Liability
To the maximum extent permitted by law, HelioLogix and its affiliates, licensors, service providers, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost revenue, lost opportunities, loss of data, loss of User Content, loss of use, property damage, personal injury, or death arising from or relating to the Service.
These limitations apply regardless of the legal theory asserted and even if a party was advised that damages were possible.
To the maximum extent permitted by law, the total aggregate liability of HelioLogix and the other covered parties for all claims arising from or relating to the Service or these Terms will not exceed the greater of:
- Fifty United States dollars; or
- The amount you paid for the applicable portion of the Service during the twelve months immediately preceding the event giving rise to the claim.
The exclusions and limitations apply independently and will remain effective even if a remedy fails of its essential purpose.
Nothing in these Terms excludes liability that cannot legally be excluded, including liability for gross negligence, willful misconduct, or other non‑waivable consumer rights.
24. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless HelioLogix and its affiliates, licensors, service providers, officers, employees, contractors, and agents from claims, losses, liabilities, damages, judgments, penalties, and reasonable legal expenses arising from:
- Your violation of these Terms.
- Your User Content.
- Your use or misuse of the Service.
- Your hunting, firearm, land‑access, navigation, equipment, location‑sharing, or connected‑device activities.
- Your violation of law.
- Your infringement or violation of another person's rights.
- A dispute between you and a person with whom you shared content or location information.
HelioLogix may control the defense of a matter subject to indemnification, and you agree to reasonably cooperate.
25. Suspension and Termination
You may stop using the Service at any time. You may request account deletion through the application or using the contact information below. See Delete your account for details.
We may suspend, restrict, or terminate your account or access when:
- You violate these Terms.
- Payment is overdue, reversed, or invalid.
- Your conduct creates legal, security, technical, or safety risk.
- We are required to do so by law or an app store.
- We discontinue the applicable Service.
Upon termination, your license ends and you must stop using the affected portions of the Service.
Termination may result in loss of access to cloud‑stored User Content. You should export or retain independent copies before deleting your account when an export feature is available.
Sections concerning ownership, feedback, disclaimers, assumption of risk, limitations of liability, indemnity, disputes, and other provisions that logically should survive will survive termination.
26. Informal Dispute Resolution
Before filing arbitration or litigation, you and HelioLogix agree to attempt to resolve the dispute informally.
A written dispute notice must describe the claimant, relevant account, facts, requested relief, and a reasonable calculation of any monetary demand.

The parties will have sixty days after receipt of a complete notice to attempt resolution. Applicable limitation periods will be tolled during this sixty‑day period to the extent permitted by law.
27. Binding Individual Arbitration and Class‑Action Waiver
Except for eligible small‑claims matters, requests for temporary injunctive relief involving intellectual property or unauthorized system access, and claims that applicable law does not permit to be arbitrated, disputes arising from or relating to these Terms or the Service will be resolved through binding individual arbitration.
Arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, as modified by these Terms. A single neutral arbitrator will conduct the proceeding.
Arbitration may occur by telephone, video conference, written submissions, or at a reasonably convenient location, as permitted by the applicable rules.
YOU AND HELIOLOGIX WAIVE THE RIGHT TO A JURY TRIAL. CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN A CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE PROCEEDING.
The arbitrator may award relief only to the individual claimant and only to the extent necessary to resolve that claimant's individual claim.
You may opt out of this arbitration provision by sending a signed written notice containing your name, account email, and a clear statement that you opt out. The notice must be received within thirty days after you first accept these Terms and must be sent to shane@heliomaps.com.
Opting out of arbitration will not affect the remaining Terms.
If the class‑action waiver is found unenforceable for a particular claim, that claim must proceed in court rather than class arbitration unless the parties agree otherwise.
28. Governing Law and Court Venue
These Terms are governed by the Federal Arbitration Act and, to the extent state law applies, the laws of the State of Texas, without regard to conflict‑of‑law rules.
For a dispute that is not subject to arbitration, you and HelioLogix consent to the exclusive jurisdiction and venue of the state and federal courts located in or serving Kendall County, Texas, unless applicable law requires a different venue.
Nothing in these Terms prevents either party from bringing an eligible individual claim in small‑claims court.
29. International and Export Compliance
The Service is operated primarily from the United States.
You agree to comply with applicable export‑control, sanctions, and local laws. You represent that you are not located in a country subject to a comprehensive United States embargo and are not included on a United States government list of prohibited or restricted parties.
You are responsible for determining whether using maps, location services, imagery, encryption, connected devices, or other features is lawful where you use them.
30. App‑Store Terms
Apple App Store
When you obtain the application through Apple's App Store:
- These Terms are between you and HelioLogix, not Apple.
- HelioLogix, not Apple, is responsible for the application and its content.
- Your license is limited to using the application on Apple‑branded products you own or control, subject to Apple's applicable usage rules, including permitted Family Sharing or volume‑purchase use.

- If the application fails to conform to an applicable warranty that cannot legally be disclaimed, you may notify Apple, and Apple may refund the purchase price paid for the application. To the maximum extent permitted by law, Apple has no other warranty obligation.
- HelioLogix, not Apple, is responsible for addressing product‑liability, legal‑compliance, consumer‑protection, privacy, or similar claims relating to the application.
- HelioLogix, not Apple, is responsible for investigating, defending, settling, and resolving claims that the application infringes a third party's intellectual‑property rights.
- You must comply with applicable third‑party agreements when using the application, including wireless‑data and internet‑service terms.
- Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce these Terms against you.

Google Play and Other Stores
When you obtain the application through Google Play or another application marketplace, you must also comply with that marketplace's applicable terms.
If these Terms conflict with mandatory marketplace rules concerning installation, billing, cancellation, refunds, or device use, the mandatory marketplace rules control to the extent of the conflict.
31. Changes to These Terms
We may update these Terms as the Service, laws, business, or risks change.
We will post the updated version and revise the effective date. When required, we may also provide notice through the application, website, account email, or another reasonable method.
Changes will apply prospectively from their effective date. Continued use after the effective date constitutes acceptance to the extent permitted by law. If you do not agree to updated Terms, you must stop using the Service.
32. General Provisions
These Terms and the Privacy Policy constitute the entire agreement concerning the Service, except for any separate written agreement between you and HelioLogix.
You may not assign or transfer these Terms without our written consent. HelioLogix may assign these Terms in connection with a merger, financing, corporate reorganization, sale of assets, or transfer of the Service.
If a provision is found invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect.
A failure to enforce a provision is not a waiver.

Except for Apple as expressly stated above and other parties expressly identified in these Terms, there are no third‑party beneficiaries.
